Integrity Labs Pty Ltd Chance to win $25,000 Instaprize Promotion

  1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this Promotion is deemed acceptance of these Terms and Conditions.
  2. The Promoter is Loyalty Fundraising Pty Ltd (ABN 51 642 660 928), 8/8 Trawalla Avenue, Toorak VIC 3142 Telephone: 0418 320 425 (“Promoter”). The Sponsor is Integrity Labs Pty Ltd trading as thedailyballer.com.au ABN(62 666 441 336) of 10 Queens road, Melbourne 3000 ("Sponsor"). The sponsor is the provider of the prize.
  3. The Promoter collects personal information (“PI“) in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to the Sponsor, agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use, and handle PI as set out in its Privacy Policy, which can be viewed at www.loyalty.com.au/privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter and Sponsor may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Entrant. The Privacy Policy also contains information about how Eligible Entrants may opt out, access, update or correct their PI, how Eligible Entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose Eligible Entrant’s personal information to any entity outside of Australia.
  4. Entry is open to Australian residents.
  5. Employees (and their immediate families) of the Promoter and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grand-parent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st Cousin.
  6. Entries into the Promotion open on 15 April 2024 and close at 11:59PM AEST on 15th May 2024. (“Promotional Period”). All times in these terms and conditions are in AEST.
  7. To be eligible to enter, Eligible Entrants must, during the Promotional Period:
    1. Visit https://thedailyballer.com/giveaways/; and
    2. Subscribe to the form and enter their correct required details and information; and
    3. Click ‘Submit’ the enter. Eligible Entrants must follow the prompts and keep the website open on their device in order to successfully complete the form and enter the draw. For clarity, all Eligible Entrants who input their details will be entered into the draw.
  8. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  9. Incomplete or indecipherable entries will be deemed invalid.
  10. If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves to right to identify the entrant.
  11. Limit of one (1) entry per Eligible Entrant.
  12. There will be a Major Prize Draw for the chance to win $25,000. The draws will take place at Integrity Labs Pty Ltd, 10 Queens Road, Melbourne 3000 at 12:00pm on the 20th February 2024. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winners will be notified by telephone and via email and will be published at www.thedailyballer.com within 5 business days of the draw.
  13. The first valid entry drawn will win that Eligible Entrant (“Participant“) the opportunity to play a contingency game (the “Game“) for the chance to win $25,000.
  14. The Game will take place at Integrity Labs Pty Ltd, 10 Queens Road, Melbourne 3000 at 12:00pm on 27th February 2024.
  15. Any and all costs associated with attending the Game are the sole responsibility of the Participant. The promoter may conduct the game via telephone or video. The Participant may appoint a proxy over 18 years of age to play the Game on his/her behalf provided the Participant gives the Promoter written, signed notice to that effect before the start of the Game. In the event that the Promoter has not been able to contact the Participant before the start of the Game, a representative of the Promoter will play the Game on the Participant’s behalf.
  16. There will be one secure pre-prepared sealed envelope at the start of the game with the winning number, between 1 and 200 (inclusive). The Participant/representative (“Attendee”) selects a number between 1 and 200 (inclusive) and a representative of the promoter records the chosen number in writing. A representative of the promoter will then open the secure sealed envelope to reveal the winning number. The Participant/representative (“Attendee”) must not touch, handle or interfere in any way with the sealed envelope. If the Attendee is found to have breached this condition, he/she will be disqualified. If the Attendee’s selected number matches the number in the sealed envelope, then, subject to verification by the judges, the drawn Participant will win $25,000. If the Attendee’s selected number does not match the number in the sealed envelope, then the $25,000 prize will not be given away and, subject to verification by the judges, the drawn Participant will win the Consolation Major Prize of a $100 NBL Store Gift Card.
  17. Winners are responsible for ensuring and checking the accuracy of the bank details provided and the Promoter is not responsible for any errors that are a result of the winners providing the incorrect details. The Promoter will not be responsible for banking institutions rejecting an EFT payment, or any costs associated with locating any lost prizes. Not providing bank details by the date requested by Promoter may result in prize payments being delayed. The Promoter is not responsible for any payments that have been successfully transferred into an incorrect nominated bank account. In these cases, there will be no further payments made.
  18. The drawn Participant’s odds of winning the $25,000 prize is 1 in 200. The odds of being drawn as a Participant may be significantly higher than the odds of the drawn Participant winning the $25,000 prize and will depend upon the number of entries received.
